    Restocking Fee

    I don't think this is legal. I ordered a BU-353 and received it DOA. I'm pretty sure when you receive a non functioning item you are entitled a total refund and can not be charged a restocking fee. Now, if I just didn't want the item, that is not MP3Car's fault, and the restocking fee should apply.

    I have ordered thousands of things online and never have I been charged a restocking fee on a broken item. The only time I have been charged is when I just ordered the wrong thing or didn't want what I ordered, which is understandable.

    If it were a larger order I would have raised a bigger fuss, but since I'm only losing <$5 (for restocking fee), it's not worth it. I will do business somewhere else for now on that I feel safe that I will get all my money back if they send me a paper weight. This should be a warning for you guys ordering stuff that are prone to be DOA like motherboards. So, all in all I'm out ~$5 for restocking, ~$8 shipping to me, and ~$9 so a total of $22 out of a $78 purchase.

    Or is this more of a rant?

    Seems it's more hassle to make this post than to send an email asking "what's the deal?"

    If something is DOA, then (at least here in the UK) there should be no re-stocking fee, they should pay for the carriage back to them and then they should ship you a new one. If they can't ship you a new one then they should refund your whole purchase price including delivery. If however they can ship you a new replacement but you don't want one they refund you the cost of the actual item.

    Yes, I talked to them over the phone and stated that I don't think it's legal to do what they were doing.

    They said they would ship me a replacement, but I already bought a new item from somewhere else. They told me that I would be paying all shipping (to and from me) plus a %5 restocking fee.

    I'm surprised they've been doing this for so long and people haven't complained before.

    If you recieved a DOA unit, and they agreed to send a replacement for free, whats the issue? You went ahead and bought one elsewhere before hearing back from them and assumed they would just send you your money back?

    I think it is more common than you think, as many retails stores assume you want a working product and would be more than happy to send you a working one at no charge. You just wanted a refund technically, as you decided to purchase it elsewhere? Am I missing something?

    Edit: On the other hand, if they told you they would send you a working replacement but with an added restocking fee, that makes no sense as they wouldnt be restocking anything. The DOA item would be returned to the vendor or set aside not to be sold again... seems weird and screwed up if thats the case.

    The policy is if item is defective you return item for a working replacement !
    You pay shipping of defective item to MP3car and Mp3car pays shipping of replacement unit back to customer.

    In your case you returned a defective item but are refusing to accept replacement item which is like returning a Item that you no longer want and the policy for that is a 15% restocking fee ... so i say you came off good with 5% charge

    and to quote NEWEGG

    So again you came off GOOD with the 5%

    Well I've RMA'd motherboards back to Newegg and I usually give them a call and they even pay for faster shipping back to me and sometimes even refund my money.

    well it's different in th UK. If the unit is defective then you have a right to reject it, and they have to pay for it to be shipped back to them and give you a full refund.

    I have had this happen on a couple of items.


    Why should the customer have to pay because they were supplied with a faulty product and then had to get it elsewhere because they needed it within a certain time.


    My advice keep chasing them for the restocking fee back plus any shipping charges incurred by you. In other words you should not be out of pocket for any of this.


    If however the product turns out to be working when they receive it back then they are within their rights to charge you.

    Yes I have seen DOA policies that state that, but it is also up to the customer to read the Return Policy and make a decision if he/she would like to do business with that retailer.
