    Some ASSHat hit me!

    So I was going to the Papa John's to go pick up my order, and I just was about to leave my neighborhood. As I was pulling up to the stop sign there was a 1974 Dodge Dart in mint condition in front of me. As slowed down to a stop, the ASSHAT throws it into reverse, squeals his tires and tags me. (he said he forgot his cell phone and was going back to get it).

    So he's freaking out saying how his dad is going to be really ****ed, and he just got a ticket last week. Anywho we go to talk with his father, who couldn't come outside because he was waisted. I got the insurance info from him. The kid ask me if we could do this without insurance. I said yeah, I just went and got the quote, it was $2500. I'm thinking he is going to reconsider his offer to do it without insurance. Now I'm not sure if they are going to total my car. I really hope they don't it's a 92' S-10 Blazer.(in pretty good shape, with 193,000 on it) If they total it, I'm going to end up having to buy a piece of crap, because I can't afford a car payment right now! I just bought a house!

    Just some friendly advice....file a police report to protect yourself. You never know if asshat's story will change, and he could even say you rear ended him.

    exactly. technically, you should of told the ASSHat to go f- himself, called a cop, and file it under insurance. since the dumbass was trying to be a hot dog, he played with fire and got burnt. i've been rear ended twice in the past 3 years and i don't play around anymore. right now I am going to physical therpy cause of the last one and had to get a lawyer since the asshat tried to change his story.

    if you had anybody else in the car, at least you have a witness. otherwise, you may want to try to find some in case the asshat changes his story.

    you gotta file it. the issue is there could be other damage that they didn't see at first that if you claim it.. it can be fixed.. instead of coming out of your pocket. I've had people hit me going like 10mph on the bumper and i always file something.

    Oh I called the police, but they said they didn't need to come out if nobody was hurt, or if nobody was Drinking and driving, or running a red light. So I made the call, the filed it. And I called his insurance Co. today.

    Michigan is the same way. Most cities' cops won't come out and file a report for an accident unless, as you said, the accident involves alcohol, a fatality, or a serious injury. You just go to the cop shop and file an mva report. But, most insurance policies require it within 48 hours. Just like the others mention, you might not notice all of the damage at first, not to mention that neck and back pain that might pop up after you hire a good lawyer

    i totally a car once as a hit a ice patch going around a turn.. I landed in a ditch and somehow got my bronco out of the ditch and drove it home. The right front wheel was totally against the wheel well.

    So we brought it to the shop and the claim agent came and looked it over and said it was only like $1,500 of work due to a dented hood and bent axle. So I called him back and told him to look under the card where my 4wheel drive system was totally busted. So he called back to let me know my car was totalled

    Yeh, I feel like he could simply say that you rear ended him. Be careful on this one.

    Wether you or he wanted to go through insurance or not is fine, the cop doesn't care. The cop HAS to take a report from all parties though.

    You might be f'd. I hope not. But in my history of accidents. I had reports taken at each one. Only one guy decided to go without insurance (I totaled his MB E class and it was his fault) He jerks me around, so, since I have his insurance info and the police report I contact them and get the money that way.

    I hope you don't get screwed. Without a police report to document the skid marks or any witnesses, it's going to be your word versus his. There's not enough money on the table for either Insurance company (assuming he even has one) to bother hiring a forensics expert to determine which car was moving in which direction. Common sense will provide a strong assumption that you hit him.

    It's the same deal here in CA. The police won't come out unless somebody was hurt or there is over X dollars in damage. Even when they do come out, they often refuse to create report -- even if asked (yes i've actually had this happen). This can result in a future problem too. Without a police report and police determination of fault, you will be penalized if you try to change insurance companies later. The new company will be unable to determine fault and will likely give you a higher premium (yes I've had this happen too).
