So Mar. 11th (or there abouts) will be the 90 day mark, right? Tell the buyer that you apologize for the shipping mistake, but that it is the fault of the company and not yours. He just needs to wait until he can collect on the insurance money.
Besides, he's not going to go through all the trouble of taking legal action against you. That would probably take longer to even start something then just waiting for the insurance money.
And, he's French. Just tell him that you will take legal action against him and he will run away!
