so that mean the law is not fair at all..
Contact a lawyer, but it will more than likely not be worth the money/trouble to go after the lady.
Did you get a ticket? A lawyer might be able to get you out of that. Insurance companies will conduct their own investigation that does not bear on if you got a ticket or not.
Also it is cheaper for them to pay out the lady vs taking her to court. The case you might want to fight is with your insurance company and not the lady (and is would be over paying a deductible and possible rate increase).
Do you have any witnesses other than her or your passengers?

But it is assumed you know the law before you drive.

Same law in this country, if you rear end someone, its your fault, very few exceptions, and good lawyers/solicitors can make it go either way.
Im all for a mandatory driving test at age 50, and then every 5 years after that. You should be either close to or in retirement by then, and a 30min test every 5yrs to PROVE you arent mentally or physically incapable of driving. I mean we get licenses at 15 in Floirda and keep them for life. Who is to say that in 35 years they wont get a tad bit senile or something and just be dangerous behind the wheel?

It is depend on where your car hit the Lincoln. A good and ***** lawyer can get you out of it, but normallly you are at fault.
Just let the insurance take care the problem and pay your "new" bill.

How is the law not fair? If you follow too closely and rear end someone, you think it should be their fault?Originally Posted by bluehcc

Yeah, but still, there are scams like this.Originally Posted by frodobaggins
A common one involves two cars. The car in the lead will slam on the brakes and the 2nd really slams them. You hit the 2nd and the 1st takes off.
This happened to my brother once while taking my mother shopping. Doing about 60mph and they just jammed the breaks. My brother was actually able to stop just short of hitting them, the person behind him was not able to stop and hit my brother. The other two cars took off. Luckily they were not injured.
I remember a long time ago, a bunch of immigrants who were running this scam tried to do it to a tractor trailer... in a civic.
That's what you get for endangering other people for a quick buck.
There still should be exceptions though.
If you suspect it's a scam, you could always have them investigated. If they have a history of lawsuits, you could probably find out. Though it sounds like they were just stupid and you didn't leave enough room.
