    Am I screw?

I bought an AKAI 42" plasma TV on new year day from Compusa.
A month and 1/2 later it broke: no color, just black an white on Composite Video and S-Video, but other inputs are fine. Another problem is that the TV doesn't response to the remote nor the button on the panel after about 1 hr of using. The only way to get the TV to response is full power down (switch off or unplug the cord.)

I call Akai tech service, and they are nice to help solve the problem. A week later Akai authorize service tech call and inform me that they will be the one who service the TV and ask me to describe the problem. Another week later (2/28), they called me and told me that they can't fix the problem cuz there isn't available part from Akai and inform me to return to the store (CompUSA).

I know CompUSA isn't take anything back after their 21 days return policy. So I called Akai Tech again and ask for the returning process. They told me just bring the TV to the store and return it. If they have problem, let the store call Akai CS and they will authorize the return.

Well, I brought the TV to the store and sure, they denied to take it back and refuse to call Akai CS, but told me to talk to the CompUSA GM. I am waiting for the store to open and call to talk to the GM.

What if CompUSA GM refused to take it back?

    So what are/is my option(s)?
    - Keep calling Akai for return or replace?
    - Call my CC and reverse the charge. It's not likely possible, but I'll try let see what they can do.
    - I really hate to go to the legal process.

I am getting a 42" Sceptre or the 42" Vizio from Costco this time.

I'm not sure about the US, but here in the UK products have to come with a minimum 1 year warranty. And the store the sells it to you is bound to honour that warranty, no matter what their returns policy is.

There is also another thing we have here whereby the product has to be fit for the purpose for what it was sold and sometimes you would reasonably expect something to last longer than that 12 month period. This one however is open to opinion.

21 days should be for if you change your mind.

you have a garuty (i can never spell that) for 1 year at least and they or the manufacturer have to honour it. Give trading standards a call (if you have such a thing at your local council).

Yes, the warranty is 1 year.
The manufacture is hornor the warranty cuz they instructed me to bring back to the store for return. I'll call the store in 1/2 hr to talk to the GM to see what the F he said.

Call your credit card bank and ask them for advice. After all, they make money off you every month, right?
They should work with the store you bought it from and possibly the manufacturer as well.
They are the ones who will have more leverage and will make the charge back threat more realistic sounding and make comp usa take action.
IMO, Compusa is hiding behind their 21 day policy, and Akai sounds like they want Compusa to take the hit for the return.
In any event, the bottom line is that it is your money that lines these companies pockets, and you deserve to get what you paid for.
If it comes down to it, file a complaint with your local consumers affairs office, or your state attorney general's offfice. Also, if any of your local tv news channels do those "protecting joe consumer" type new spots, calll them too. Here in Detroit, Fox2 and WDIV (NBC Channel 4) both have reporters that go after companies that wont do what they say. With very good results.

If you are going to return the TV for a full refund that has to be within 21 days. But since you want to exchange it for one that actually works, they might take it back. I read their exchange policy online and it seems to me that they don’t want to deal with any warranties after the 21 days so you are going to have to have GM approval and such. You probably are better off working with Akai since they are willing to fix it. They just don’t have a way to fix it. They are the ones who have to enforce the warranty so if your going to get into legal, they are the ones that must take care of it, not CompUSA.

Stick with talking to Akai and explaining to them that CompUSA will not take it back. If you do talk to the GM, explain to him that you don’t want a refund but rather a working TV to exchange for, maybe he might exchange it.

Well, I called CompUSA GM and he said that he has to talk to Akai regarding RMA process. I think this is BS cuz he should know how it works.

Anyway, I called Akai to get the RMA myself, but they keep transfering me around and to the dead end which the answering machine asking me to leave info for them to call me back.
Finally I talk to one CS at Akai and she said that there are parts available to fix the TV. And advise me to call the Service Center to have them called to order part. I called and talked to the Service Center and the tech told me that Akai want him to do components repairs. But he has to contact them to see what kind of parts available for the modle because base on the info he has, there is NO parts for the remote unit.

    $hit, I want a fu<king working TV.
That's it no more Akai, no more CompUSA for me. Costco for now.

Wiredwrx, I need your advise here. Normally you are good at these legal stuff.

    For those who still interest.

Compusa GM called me on Friday around 4 pm and leave me a message saying that he is working on the matter. Basically he send a request for RMA to Akai and waiting for them to reply. And will call me back if "anything" new. So I went in store and talk to the GM in person. Basically what he said is up to Akai. He'll take the TV back if Akai give them the credit for the TV. Without the RMA he is not taking back the TV.

Well Monday (3/6), I called Akai again to kindly ask them to reply to the RMA request by Compusa's GM. After 2 transfers, I talk to someone in charge of issuing RMA from Akai. Basically what he said is that I can't have the RMA. Only the store can have it and Akai won't issue and RMA if the store doesn't have the TV.. I just told him that the store won't take back without the RMA, and he said if the store doesn't have the unit, he doesn't issue the RMA. Anyway, I gave him the GM info so they can talk.

Okay, now both the manufacture and the retailer are kicking each other *** and I am stuck in the middle.
I gave them 2 more weeks (3/20) to solve the problem. Otherwise, I'll call my CC and do a charge back. I go this route cuz I know the CC company can talk LOUNDER than I am. If the CC isn't lound enought, I think the judge voice will. ****, time to use my friend's bro.
