Thread: Suing somebody in another state (Wiredwrx is invited too!)

    I know this is off topic to the thread, but it is relative to your application. Does it have the ability to tie into online systems like monster.com? I would imagine that might be a pretty powerful feature specifically in the technical field. I have never actually used monster.com to look for employees, but I know a lot of recruiters and placement agencies (large and small) use monster.com for these types of things. Would be nice to be able to automatically download contractor/employee information into a database like you have for offline search and storage. Just a thought.

    well the design specifications were to specifically create a program that does not need the web to function. And the final product doesn't. Only the half of the trial versions have the activation need.

    I have pretty much stopped working on it because I have no need for it, and it doesn't look like I'll be getting paid for it anyways.

    But that would be cool.

    I am surprised that the court allowed such a thing. If the countersuit was related to the your suit in some way, say, you say you gave him a program, and he failed to pay you, and he countersues saying, yes, you gave me a program, but it doesn't do what it is supposed to, so I want my money back/not to pay, then the other side is REQUIRED to raise this in thier answer to your lawsuit.

    Also, you make it sound as if you were not served with any papers regarding the lawsuit. They are required, BY LAW, to serve you with the papers about the lawsuit (called a summons and complaint). They can't just announce in court, WE ARE SUING YOU. It just doesn't work that way. Were they two seperate suits, or one.

    Also, what is the courts Jurisdiction over you. You had to sue him in his home state, HE HAS TO SUE YOU IN HIS HOME STATE, unless it is a counter claim.

    I had to re-read your original post, I did not realize this was a custom job. I would imagine if he broke the contract that you would own the rights to the source. If I were you, after having sunk development time on something like that, I would take it a step further and try to make the project more generic and publicly marketable. Perhaps you could get some money for your time.

    well a good freelance programmer would have it so he owned the code even with them have a final project so he could do as you say and change it to make it more publicly and more money.

    but this type of thing doenst seem too special (no offensive meant from a fellow programmer), so im sure it has been done, probably could even be done with like ms access. so there is probably not too many interested people.

    but i hope you can get something for it.

    correct. This would have been exclusive rights to him because he was willing to pay $200 more for the "exclusive rights". $200 in monopoly money isn't much at all!

    I don't see this program being very useful to anybody else other than other contractors.
