    eBay A$$

    So, I bought This off of ebay...go ahead tell me i overpayed...anyways

    I bought it last saturday, I payed with paypal that day and awaited monday for the guy to ship..So tues rolls around and I sent him a msg asking if he shipped or not, nothing tell wends..He replies telling there is a "death in the family" and that he will ship tommorw (thurs.) Thurs and nothing, so i figure its shipped and on its way..Friday, I send him another message asking if there is a tracking number...He replies later that night with a number and shipped it thurs..

    So, I wait tell saturday and recieve the package. The auction says its only 2months old and its in the orginal packing...So I get home and there it is, on the porch, IN the original box, ITS BEAT UP!! OK.. im thinking okay maybe its packedged good inside...NOPE!! The indash sitting mixed it with some peanuts..the ******* remote is broke apart, (still works tho)

    So im ****ed becuz I just dropped $500 on this p0s and im..ARG! So I do a bench test to see if all the features work..Everything is in order cept I cant seem to ground the parking brake..But everything is good...cept theres an audio CD in there..I press eject...the indash beeps, but the cd doesnt come out!! WTF!! First of all, he LIED about shipping and then he NEVER told me about the CD being stuck in there...OMFG!

    Okay, Im done ranting, off to work..

    File a "not as described" complaint with ebay and Paypal.
    Also indicate in your complaints the shipping damage due to sellers poor shipping.
    Be sure to be very specific. Paypal may side with you and give a refund after you ship that pos back. Just because his auctiobn says no returns, that means nothing. Paypal will take care of you before they worry about the seller.

    eBay people are getting real bad. Personally I would've never bought from this guy...not a $500 item. He's sold only 1 item, the rest he bought.

    Did you try to work something out with him yet?

    On EBay I always start with the assumption that whoever is selling whatever they are trying tp pull the wool over your eyes. (Basically the complete opposite attitude to the rest of my life,) Then I let their actions do the talking for them. Having sold only 1 item, I’m afraid your Ebay A$$ doesn’t have much to say for himself.

    There is no way in the world that he didn’t know he had a CD stuck in the drive! I’d take motorcity’s advice and start with PayPal. It’s hard to see how it could be anything else but “not as described”.

    Paypal and ebay don't acknowledge any disclaimers in any auctions as being valid. If they feel like refunding you, they will. Trust me on this, I have been on both sides of a disclaimer battle.

    I do agree that the disclaimer seems to indicate a pos being sold. However, I too put a similiar note in my used parts auctions. But I also offer a no doa period. Plus I pack, or over pack all items to ensure safe delivery. Except for this one time I sent a pack to AU, but that's another story.....

    Okay good news and bad news..yesterday I sent him a message...copied from ebay...

    Recieved the inash yesterday...First of all I spent $500 on this indash and you poorly packaged it, the remote broke apart and the box was tore up. Come on man..Second, there is a CD stuck in the drive, I dont know if this was caused buy shipping or what happened. You failed to tell me these issues, I hate to leave negative feedback, but what the hell man? $500 and you can spend $15 to package it right and EVEN tell me there is a CD stuck? What the hell man...

    Then today, I get this...

    When item was shipped it was perfect, the battery's in the remote were low the last time i used it. i dont understand how the cd could be stuck i most have been thrown around or bump or something during shipping.

    I'm not sure what to do, I mean I tried the indash out in my car and it sounds pretty damn good, BUT the cd is still stuck in the drive...I would like to keep this unit, but If i report to paypal, do I send it back?

    Do not send anything back unless Paypal tells you to do so.
    Even if the seller agrees to a refund, wait until after Paypal says they want the item returned to the seller. I suggest you file the not as described complaint through your paypal account, and they will tell you how to proceed from there. Do this to protect yourself.
    You may screw yourself if the seller agrees to a refund without Paypal intervention. You ship it back then he disappears with your $$.

    Okay, I setup a claim with paypal. Under "I received my item, but it was significantly different than the seller's description."
    I wrote this...

    The item was shipped in a poorly packaged box with no other packing besides shipping peanuts, and the remote was apart in pieces. Also upon bench testing the unit, there was an audio cd stuck inside the drive. When the eject button was pressed, the unit beeped, no sound such as motor turning and did not eject. After handling the unit, it appears something may be broken inside, there sounds like a piece of plastic tumbling around.

    Anything I should add?

    I would word it like this:

    The (INSERT ITEM NAME HERE) was shipped in only it's retail box. No additional packaging was used. Damage due to this occured. Further, the (INSERT ITEM NAME HERE) is not operational. There appears to be a CD stuck inside, and it will not eject. Loose parts can also be heard inside. The stuck CD was not mentioned in the auction item's description, and the seller is not willing to assist. He is blaming the shipping carrier for the damage.
