The lawyer somehow proved that a dvd could have been playing cause there were dvd's cases opened in the car when the accident happened.

Well, any judge worth anything, wouldn't let somebody win case because a DVD COULD have been playing. You need proof, and facts, somebodys opinion really SHOULDN'T mean squat in court, it should be the facts.
