Legal issue, anything I can do?

Hi there, anyone who's missed me

After receiving a support request from somebody referring to Map Monkey as "Navellite" I've discovered that somebody is selling the app under a different name (though obviously not changing email addresses for support!) and making a profit out of my freeware :-(

Does anyone on here know if there's anything I can do? I know I never included a license.txt saying it can't be redistributed so I'm not feeling hopeful - but still, any suggestions...?

A license might modify/explain the rights granted to a user of your software, but general US Copyright laws protect your original work of authorship, wether you include a license or not.

Just so you know, the US copyright law doesn't care if he is making money or not, all that matters is if he is violating any of the exclusive rights granted and reserved in the author of the work. His "profit" only matters if you sue him for money--realize that you can sue him to stop distributing your software, EVEN IF HE DOES SO FOR FREE.

I would contact the seller, ask him to stop, and also send him what is called a "cease and desist" letter. That usually works pretty well. If it does not, you will most likely need a lawyer.

Wiredwrx is correct.
Majority of people think that because you didn't inlcude copyright or license notice that it's ok to take it. Where in fact, like already stated, you orginal work is protected whether you say it is or not.
I've been a photographer for many years and I've never put any copyright info on my work but when I need to let someone know that they can't use them without my permission a simple e-mail usually worked.
