Start googling man.
Do what turbocad said. Ask them back if are they willing to pay tax if you purchase a 40K car.
They SHOULD paid you base on the value of the car you loss.

Of course I googled it, I post on diferent insurance forums and they all say that my best chance is to sign the reimbursement agreement:

so if you buy the 2500 car that's all they pay tax on & that's it? or will you still have "credit" for future purchase(s) up to the settlement amount?

I thought on doing that but, what they want to do is keep me as a custumer so they can increase my premiun so if I buy the $2500 car they will know so I guess there is no way to hide it.

now adays insurance companies in general are looking to save as much as possible, force inferior parts on jobs & refuse to pay anymore than they have to, it's all a numbers game to them, even to the point that when they do issue a payment, they ALWAYS do so from an out of state account, just to have that few extra days of interest  I've never seen them do this though...
I guess as long as it's a term on your policy then they can do it... I've never seen them do this in ny as far as I know, but when a car is totalled I'm usually out of the loop at that point & don't see all the actual settlements there either so who knows, maybe this is happening out there too,some insurance companies suck, which company is it?
